数字时代金融数据跨境流动的法律规制研究

摘要: 数字经济背景下，金融数据跨境流动已成为金融服务全球化的推动力，不同的国家和地区对金融数据跨境流动呈现出不同的规制模式。美国对金融数据跨境流动持开放态度，欧盟在金融数据跨境流动规制中着重保护个人权利。中国在金融数据跨境流动方面将国家安全放在首位。本文认为，为了更好地激发金融市场活力，有必要调整规制思路，并在金融数据控制者范围、金融数据分级监管等方面进行完善，逐步实现金融数据跨境流动规则的有序化。

Abstract: Against the backdrop of the digital economy, the cross-border flow of financial data has become a driving force for the globalization of financial services. Different countries and regions exhibit varying regulatory models for the cross-border flow of financial data. The United States maintains an open attitude toward the cross-border flow of financial data, while the European Union emphasizes the protection of individual rights in the regulations of cross-border financial data flow. China prioritizes national security in the cross-border flow of financial data. This paper argues that to better stimulate the vitality of financial markets, it is necessary to adjust regulatory approaches and enhance regulations in areas such as the scope of financial data controllers and the graded supervision of financial data. This will gradually achieve the orderly development of rules governing the cross-border flow of financial data.
