纪检监察自主知识体系的案例学建构：应因、困境与路径

摘要: 纪检监察学科具有鲜明的实践性特征，其知识体系的生成蕴含着自主性和原创性的机理，并形成了丰富的案例资源。纪检监察案例中承载着我国丰富的权力监督经验，对于提炼原理论，补强解释法律条文与指导实务工作具有重要的学科意义。当下纪检监察案例学的构建，面临研究对象模糊，研究范式缺乏，成果转化受阻三个方面的困境。综合考虑案例生成、分析以及应用过程的一般性原理，形成纪检监察案例学的基本路径可以从科学的案例选择与整理，理论化的案例研究范式，实践导向的案例成果转化三个方面进行系统性构建。

Abstract: Discipline inspection and supervision discipline has distinct practical characteristics, and the generation of its knowledge system contains the mechanism of autonomy and originality, and forms rich case resources. Discipline inspection and supervision cases carry rich experience of power supervision in China, which is of great disciplinary significance for refining the original theory, reinforcing the interpretation of legal provisions and guiding practical work. At present, the construction of the discipline inspection and supervision case study is facing three difficulties: the ambiguity of the research object, the lack of research paradigm and the obstruction of the transformation of achievements. Considering the general principles of case generation, analysis and application, the basic path of discipline inspection and supervision case study can be systematically constructed from three aspects: scientific case selection and collation, theoretical case study paradigm, and practice-oriented case achievement transformation.
