情报伦理框架的发展脉络与演变逻辑

摘要: [目的/意义] 情报伦理框架是情报活动所应遵循的价值准则与伦理规范，是评价情报活动是否符合伦理准则的依据，揭示情报伦理框架的发展脉络及演变逻辑，能够为建立情报伦理框架提供理论基础。[方法/过程]以学术文献为中心，运用学术史方法历时性梳理情报伦理框架的发展脉络，分析其演变动力与逻辑。[结果/结论]情报伦理框架经历了朴素的情报不道德论、反恐时代正义情报论、大数据时代升级阶梯情报伦理框架主要发展阶段，形成了由“正当理由、合法授权、正当目的、比例原则、理性原则、目标相符”伦理准则构成的正义情报理论；情报伦理框架演变背后的底层逻辑是生存发展的安全利益同个人自由与隐私权益之间的权衡博弈，在众多驱动因素中安全形势、威胁感知、新兴技术三大因素的影响最为直接深刻。

Abstract:
[Purpose/significance] The intelligence ethics framework comprises the value criteria and ethical norms that should guide intelligence activities. It serves as the foundation for assessing whether intelligence activities conform to ethical standards. Exploring the development and evolution of the intelligence ethics framework and its underlying logic can provide a theoretical basis for its establishment. [Method/process] Focusing on academic literature, this study employs the method of academic history to chronologically review the developmental trajectory of the intelligence ethics framework and analyze the dynamics and logic behind its evolution. [Result/conclusion] The study reveals that the intelligence ethics framework has undergone significant developmental stages, including the "primitive theory of unethical intelligence, the justice intelligence theory in the anti-terrorism era, and the upgraded stepwise intelligence ethics framework in the big data era." It has evolved into a theory of just intelligence that encompasses ethical principles such as "just cause, lawful authority, legitimate purpose, proportionality principle, rationality principle, and alignment with objectives." The fundamental logic driving the evolution of the intelligence ethics framework is the balancing act between the security interests of survival and development and the rights to individual freedom and privacy. Among various driving factors, the security situation, threat perception, and emerging technologies exert the most direct and profound influence.
