党内法规体系再访

摘要: 中国共产党党内法规体系的进一步完善，在国有企业和社会组织中形塑了一种“国法—党规”二元渊源的组织内部规范。这一规范具有社会规范性、合法性（合法律性）和党内法规属性“三重性”。二元渊源的组织内部规范对现有党内法规体系的完备性构成了一定挑战。由党内法规体系、党内规范性文件体系、党的规矩（惯例）等不成文规范体系和二元渊源的组织内部规范体系及其他体系性的党规现象构成的“党规体系”，完备地指涉了党内规范体系，解决了“党内法规体系”的完备性问题。进一步，党内法规研究应更多关注现实中的党内法规实践，丰富党内法规的理论域和理论体系。

Abstract: The further improvement of the system of Intraparty Rules and Regulations (IPRR) of the Communist Party of China (CPC) has shaped an internal organizational norms of "state law—party rule" with dual-origin in state-owned enterprises and social organizations. This norm exhibits a tripartite nature of social normativity, legality, and intraparty regulatory characteristics. The internal organizational norms with dual-origin presents a certain challenge to the comprehensiveness of the current IPRR system. The "party regulation system," which is composed of the system of IPRRs, the system of intraparty normative documents, the Party’s rules (customs), unwritten normative systems, and internal organizational norms with dual-origin and other systemic party regulatory phenomena, comprehensively addresses the issue of completeness. Furthermore, research on party regulations should focus more on the practice of party regulations in reality, enriching the theoretical domain and system of party regulations.
