《管子》整全规范理论体系论绎

摘要:     《管子》具有融合儒、道、法三家色彩的特质,由法学视域观之,其规范理论体系亦颇为整全。 于规范本源论层面,《管子》以道为最高,进而引道入治,为社会规范奠定至高哲学本源;于规范价值论层面,《管子》并王霸之道,
合拢秩序功效,彰扬民众德性,恪奉良善规范价值;于规范本体论层面,《管子》以道为基,衍化各类社会规则,以求德目法度整全并各显其效;于规范位阶论层面,《管子》消弭礼法分歧,统合规范功能,主张礼法并重而治;于规范实施
论层面,《管子》追求举国上下皆从法的实施效果,赏罚并举而倡规范教化,慎刑罚制裁。 《管子》代表了一种兼合而整全的规范理论,不啻古典法律思想史上一种具有创造性的体系构建。

Abstract:     Guan Zi integrates Confucianism, Taoism and Legalism and develops a comprehensive theoretical normative system when viewed from the perspective of jurisprudence. At the level of its normative
foundation, Guan Zi takes the Tao as its origin and introduces Tao into governance and thus lays the supreme philosophical origin for social norms; at the level of its normative value, Guan Zi combines the principles of the kingly way and ruling by force, combines the efficacy of order, promotes the virtue of the people, and adheres to the good normative value; at the level of its normative ontology, Guan Zi takes Tao as the foundation and derives various social rules to achieve the integrity and effectiveness of moral items and legal systems; at the level of its normative hierarchy, Guan Zi eliminates the differences between rites and laws, unifies the functions of norms, and advocates governing with equal emphasis on rites and laws; at the level of normative implementation, Guan Zi pursues the implementation effect that the whole country follows the law, combines rewards and punishments to advocate normative enlightenment, and is cautious about criminal sanctions.Guan Zi represents an integrated and comprehensive normative theory, which is nothing less than a creative system construction in the history of classical legal thought.
