高校派驻监督制度改革：实践、理论及反思

摘要: 派驻监督是实现“公职人员全覆盖"这一监察体制改革目标的重要一环，近年来被推广应用至反腐任务艰巨的高等学校。各地各级的部分高校开展了广泛的“扩面型”试点，其中可归纳为包括中管高校在内且应用最广的合署模式和天津市属高校开创的颇具特色的独立模式，这也属于“指定型”试点并处于从“前试点阶段”向"试点阶段”过渡的进程中。基于此，有必要结合公法原理进一步分析派驻机构的组织逻辑，从而实现理论与实践的互动与反思。其法律地位可以用“间接国家机关”或“行政单位”加以界定，具有组织的从属性、法律能力的部分性，接着探讨其职权的范围界定，包括对事管辖权与对人管辖权，以及行权限度，即遵循民主原则、功能适当原则和比例原则，从而为实践的后续发展提供启示。《监察法》派驻条款的“差异化授权”以上改革试验提供了充分的制度空间。

Abstract: Accredited supervision is an important part of “full coverage of public officials”, which is the goal of the reform of the supervisory system. In recent years, it has been extended to colleges and universities, which have a difficult task in combating corruption. Some colleges and universities at various levels around the country have carried out a wide range of “expansion-type” pilots, which can be summarized as the most widely used co-location model, including central management universities, and the distinctive independent model pioneered by Tianjin municipal colleges and universities. It also belongs to the “designation-type” pilots and is in the process of transitioning from the “pre-pilot stage” to the “pilot stage”. It is necessary to further analyse the organizational logic of the accredited institutions in the light of the principles of public law, so as to achieve interaction and reflection between theory and practice. Its legal status can be defined in terms of “indirect state organ” or “administrative unit”, with the subordination of organizations and the partiality of legal capacity. The article discussed the scope of its authority, including subject jurisdiction and personal jurisdiction, as well as the limits of the exercise of its powers, including principle of democracy, functional appropriateness and proportionality. The discussion above sheds light on the subsequent development of accredited supervision practice. The differentiated authorization by the accredited supervision provisions of the Supervision Law provides sufficient institutional space for the above reform experiment.
