党的纪律教义学的体系化构造

摘要: 内容摘要：党的纪律的教义学化是纪检监察学的基本任务之一，是保证执纪工作合理性、一致性、稳定性的重要方式。应当从党的领导和党的建设需要出发，构建本土化的“纪纲一纪体一纪责一纪量"理论体系。纪纲是违纪行为的规范本体论，承担着党的纪律的总论功能，揭示了违纪行为在本质上存在三重违反性，即违反了党员的基本义务、违反了党组织的纯洁性和先进性要求、违反了党规国法和政策方针，党要管党，就必须全面加强党的纪律建设，严肃追究违纪责任。纪体、纪责、纪量共同组成了违纪行为的构成要件，属于党的纪律的分论。其中，纪体是违纪行为的客观认识论，规定了违纪行为的行为主体、行为类型、行为后果；纪责是违纪行为的主体认识论，规定了违纪行为的主观明知、动机目的和态度表现；纪量是违纪行为的衡量方法论，对案件情节进行整体性评价，结合政策综合考量，最终确定对违犯行为的具体纪律处分。

Abstract: The doctrinalization of the Party’s discipline is a key focus of discipline inspection and supervision studies, playing a crucial role in ensuring the coherence, consistency, and stability of disciplinary work. To achieve this, it is essential to establish a localized theoretical system that encompasses "discipline principles, disciplinary bodies, disciplinary responsibilities, and disciplinary measures." The discipline principles act as the foundational framework for guiding disciplinary behavior, serving as the cornerstone of the Party’s discipline. These principles highlight the three core aspects of disciplinary violations: breaching the fundamental duties of party members, undermining the integrity and progressiveness of party organizations, and contravening party regulations, national laws, and policy directives. Effectively managing the Party requires a comprehensive strengthening of disciplinary construction and holding those accountable for violations to a high standard. The disciplinary bodies, responsibilities, and measures collectively form the essential components of disciplinary behavior, falling within the realm of the Party’s discipline. The disciplinary bodies provide an objective perspective on disciplinary actions, outlining the actors, types, and repercussions of such behavior. Disciplinary responsibilities address the subjective aspects of disciplinary behavior, defining the mindset, intentions, and attitudes of the offenders. Meanwhile, disciplinary measures offer a methodical approach for assessing the severity of violations, taking into account various factors such as the circumstances of the case and policy considerations to determine appropriate disciplinary actions.
