全流程视角下档案数字化建设中著作权风险分析与管理

摘要: 目的/意义 档案数字化建设给档案著作权保护带来了新挑战，系统分析并科学管理著作权风险，有助于合法有序推进档案数字化建设、推动档案工作现代化发展。 方法/过程 基于全流程视角，系统分析档案数字化建设前期（数字化建设准备工作）、中期（数字化复制、存储、开发）、后期（数字化传播、利用）各阶段、各环节中的著作权风险，进一步明确相应风险管理策略。 结果/结论 建议在档案数字化建设前期实施著作权事宜咨询与状态审查以规避风险，中期实施著作权过程管理与长效监督以控制风险，后期实施著作权义务履行与用户规范以防范风险，从而建立起著作权风险全流程管理体系，实现全方位风险管理。

Abstract: Purpose/Significance  Digitization construction of archives brings new challenges to archival copyright protection, and clarifying the copyright risks involved and managing them effectively can help promote the legal advancement of the digitization construction of archives and the modernization development of archival undertakings.  Method/Process  From the perspective of whole-process, it systematically analyzes the copyright risks in each process of digitization construction of archives, including the early stage (preparation), the middle stage (reproduction, storage, and development), the later stage (dissemination, and utilization), and further clarifies the copyright risks management strategies.  Result/Conclusion It is supposed to implement copyright matters consultation and copyright status examination in the early stage, copyright process management and long-term supervision in the middle stage, and copyright obligation compliance and user regulation in the later stage, to establish a whole-process management system of copyright risks and realize all-round risk management.
