对《档案法》修订草案的几点意见

摘要: 《档案法》修订草案在保障公民权利、强调档案的形成及其责任、强化档案行政监管、细化档案违法行为及处罚等方面具有进步性,在立法语言严谨性、法条内容合理性、法律体系协调性等方面存在局限性,建议坚持慎重修法的原则、贯彻以人为本的立法理念、使用规范严谨的法律语言、构建协调一致的法规体系。

Abstract: The revised draft of Archives Act has made advances in protecting civil rights, emphasizing the formation of the archive and its responsibilities, strengthening the archive administrative supervision.and detailing illegal behaviors and punishment. And it has the limitations in the rigor of legislative language, the rationality of the law and the coordination of legal system, This article proposes to adhere to the principle of revise the law carefully the implementation of people-oriented legislative philosophy, the use of rigorous legal language, the building of a consistent system of laws and regulations.
