新《档案法》实施背景下档案法规体系建设的困境与出路

摘要: 新《档案法》实施背景下，与旧《档案法》相配套的档案法规体系面临 着过时的危险，亟待全面修改。新《档案法》的内容存在十大亮点，我们要从坚持党 对档案工作的领导、推进国家治理体系和能力现代化、改进档案管理工作等方面来把 握其实施意义。现有档案法规的制定程序缺乏专家论证，科学性不强；部分内容与 新《档案法》冲突，体系性不强；法规与上位法及彼此之间高度重复，未凸显地方特 色，针对性和可操作性不强。因此，我国应当从整体上完善档案法规体系。具体路径 包括各地区在修订档案法规时，对档案法规草案进行专家论证，必要时委托第三方起 草，提升档案法规立法的科学性；通过立法后评估、定期清理和备案审查，增强档案法 规立法的体系性；在档案法规立法过程中广泛听取社会意见，凸显地方特色。

Abstract: Under the background of the implementation of the new archives law, the archives legal system supporting the old archives law is facing the danger of being outdated and needs to be comprehensively revised. There are ten highlights in the content of the new archives law. We must grasp the significance of its implementation in terms of upholding the party's leadership over archives work, advancing the modernization of the national governance system and capabilities, and improving archive management.The procedures for formulating existing archives laws and regulations lack expert argumentation and are not scientifically strong; part of the content conflicts with the new Archives Law, and the system is not strong; the legislation and the upper law are highly overlapping with each other, without highlighting local characteristics, pertinence and harmony. The operability is not strong. Therefore, our country should improve the file law system as a whole. The specific path includes: when each region revises the archives regulations, conduct expert demonstrations on the drafts of the archives regulations, entrust a third party to draft when necessary, and enhance the scientificity of the archives regulations and legislation; strengthen the archives regulations through post-legislative evaluation, regular cleaning and filing review work Legislation is systematic; in the process of legislation on archives laws and regulations, opinions from the society are widely listened to, highlighting local characteristics.
