新《档案法》规制下档案利用与公布中的法律法规衔接研究

摘要: 在全面依法治国的背景下，文章通过梳理我国新修订《档案法》《中华人民共和国著作权法》《中华人民共 和国信息公开条例》等法律法规中的有关条文，从信息公开、知识产权保护和隐私保护三个层面分别论述了在档案利用 公布环节中处于封闭期与开放期的档案、档案公布权与著作发表权、数字档案、涉及个人信息及个人隐私档案等方面的 法律法规衔接问题。

Abstract: Under the background of comprehensively governing the country according to law, this article combs the relevant provisions of laws and regulations such as Archives Law, Copyright Law of the People's Republic of China and Regulations of the People's Republic of China on Information Disclosure. From the three aspects of information disclosure, intellectual property rights protection and privacy protection, this paper discusses the convergence of laws and regulations on archives in closed period and open period, the right to publish archives and the right to publish works, digital archives, personal information involved in archives and personal privacy.
