档案服务企业数字化业务中的 合同纠纷及解决路径研究

摘要: 随着档案服务市场的扩大，档案服务企业与服务对象之间的合同纠纷成为制约档案数 字化业务开展的现实问题。文章对档案服务企业数字化过程中的合同纠纷案件展开调查，发现合 同条款内容模糊、企业间分包挂靠关系混乱是其外在表征。在对法院判决结果梳理之后，文章根 据在合同制定、执行及验收各环节中存在的诸多问题提出针对性的解决路径，以期为解答档案服 务业中的合同纠纷问题提供借鉴。 

Abstract: With the expansion of the archival service market, contract disputes between archival service enterprises and clients have become a realistic problem that restricts the development of digital archival business. This paper investigates the contract dispute cases in the digitization process of archival service enterprises, and finds that the ambiguity of contract terms and the confusion of subcontracting affiliations between enterprises are the external manifestations. After sorting out the results of the court’s judgments, this article puts forward a targeted solution based on the problems existing in the contract formulation, implementation and acceptance, in order to provide references for solving contract disputes in the archival service industry.
