数智时代智慧图书馆信息隐私多元规制与社会规范*

摘要: [目的/意义]在大数据、人工智能等新一代数智技术的推动下，人类社会迎来了前所未有的发展机遇，然而，这也引发了个人信息安全风险的增加。智慧图书馆的建设和发展，高度依赖于个人信息的利用。如何在个人信息的利用与保护之间实现利益平衡，已成为智慧图书馆在信息隐私多元规制和社会规范方面亟须解决的关键问题。[方法/过程]本研究以智慧图书馆利益相关者的信息需求为切入点，综合运用人格权、财产权、控制权以及隐私权等理论框架，深入探讨了传统隐私、传统个人信息以及新型个人信息权益的演变、侵害、识别、选择以及相关制度安排等问题，旨在辨析智慧图书馆个人信息利用与保护之间的利益平衡问题。[结果/结论]个人信息权益的保障构成了智慧图书馆在数智时代实现高质量发展的基石。该机制能够实现个人利益、财产利益与公共利益之间的有效均衡，对于增强信息流动、合理分配资源以及维护信息秩序方面，具有一定的理论意义与实践价值。

Abstract: [Purpose/significance]Driven by a new generation of digital intelligence technologies such as big data and artificial intelligence, human society has ushered in unprecedented development opportunities, however, it has also led to an increase in personal information security risks. The construction and development of smart library is highly dependent on the use of personal information. How to balance the interests between the use and protection of personal information has become a key issue that smart libraries need to solve in terms of multiple regulations and social norms of information privacy.[Method/process]This study takes the information needs of smart library stakeholders as the starting point, comprehensively uses the theoretical framework of personality rights, property rights, control rights and privacy rights, and deeply discusses the evolution, infringement, identification, selection and related institutional arrangements of traditional privacy, traditional personal information and new personal information rights and interests. The purpose is to analyze the balance of interests between the use and protection of personal information in the smart library.[Results/conclusions]The protection of personal information rights and interests constitutes the cornerstone for the smart library to achieve high-quality development in the era of digital intelligence. This mechanism can realize the effective balance between personal interests, property interests and public interests, and has certain theoretical significance and practical value for enhancing information flow, rationally allocating resources and maintaining information order.
