系统论视角下环境法律责任协调性的建构路径

Synergistic Construction of Environmental Legal Liability: A Systems Theory Approach to Regulatory Framework Design

摘要: 环境法律责任协调性研究的直接目的在于促进环境法律责任组成部分有机融合为一个和谐的整体系统,根本目标则在于推进环境法律责任协调发展。当前,环境法律责任体系在制度设计层面存在法律属性冲突,在适用层面则呈现出重复追责以及重罚倾向等现实困境。通过分析协调性的历史与现代理论涵义,可发现协调性建构对于环境法律责任体系实现系统化整合以及制度协同效应具有重要价值。对于环境法律责任体系的失调表现及其理论困境,系统理论在解决环境法律责任体系整合、功能优化与制度协动方面展现出独特的理论优势与范式适配性。具言之,基于一般系统理论中关于系统协调协调原理、耗散结构理论的协同演化机制以及社会分工理论的功能分化规律,共同构成了环境法律责任协调性建构的三维基准体系。

Abstract: The study on the coordination of environmental legal liability aims at promoting the organic integration of its components into a harmonious systemic whole as its immediate objective, with the fundamental goal of advancing the coordinated development of environmental legal liability. Currently, the environmental legal liability system faces normative conflicts in institutional design and practical dilemmas in application, such as improper handling of liability concurrence and imbalanced penalty severity. By analyzing the historical evolution and modern theoretical connotations of coordination, this study reveals that the construction of coordination holds critical value in achieving systemic integration and institutional synergy within the environmental legal liability framework. In addressing the structural dissonance of the environmental legal liability system and its theoretical challenges, systems theory demonstrates unique advantages and paradigm compatibility in resolving systemic integration, functional optimization, and institutional coordination. Specifically, the three-dimensional benchmark system for constructing coordination in environmental legal liability is established through the system coordination principles of general systems theory, the synergistic evolution mechanisms of dissipative structure theory, and the functional differentiation principles derived from social division of labor theory.
