摘要: 本文聚焦国企工会在当前面临劳动法律法规适应性不足、多元主体协同困境、基层治理能力短板等挑战情形下,通过对制度韧性内涵要素及“枫桥经验”起源、发展的理论阐释,揭示二者紧密联系。深入剖析国企工会在党的领导运用枫桥经验解决劳动纠纷和预先化解矛盾,逐步形成以党建引领为核心保障、多元共治构建协同格局、预防为主进行源头治理、就地解决实现高效化解的实践逻辑,进而反映工会助力基层治理的路径和功能,完善法律制度、强化多元协同、提升基层能力、创新治理理念等创新路径,旨在为劳动领域纠纷治理提供理论支撑与实践参考,促进劳动关系和谐稳定。
Abstract: Abstract: This article focuses on the challenges currently faced by state-owned enterprise (SOE) trade unions, including insufficient adaptability to labor laws and regulations, difficulties in multi-stakeholder collaboration, and shortcomings in grassroots governance capabilities. Through a theoretical analysis of the conceptual elements of institutional resilience and the origin and development of the "Fengqiao Experience," it reveals the intrinsic connection between the two. The study delves into how SOE trade unions, under the leadership of the Party, apply the Fengqiao Experience to resolve labor disputes and preemptively mitigate conflicts. This practice has gradually formed a governance logic centered on Party leadership as the core safeguard, multi-stakeholder collaboration to build synergy, proactive prevention for source governance, and localized resolution for efficient conflict mitigation. The article further reflects on the pathways and functions of trade unions in aiding grassroots governance, proposing innovative solutions such as improving legal frameworks, strengthening multi-stakeholder coordination, enhancing grassroots capabilities, and innovating governance concepts. The aim is to provide theoretical and practical insights for the governance of labor-related disputes, thereby promoting harmony and stability in labor relations.
