基层立法联系点的宪法路径

摘要: 作为发展全过程人民民主的重要举措，基层立法联系点的创设具有宪法依据，其功能实现须借助于宪法的制度、组织和程序。我国宪法中的国家任务规范、直接民主规范与组织活动规范，能够满足创设基层立法联系点的实质合宪要求。基层立法联系点作为代议民主的内部补强制度，在组织运作中应当定位为公众利益表达的常设机构。基层立法联系点的宪法实现，需要将“全链条、全方位、全覆盖”的全过程人民民主理念贯彻其中，并在实践中加强建设。

Abstract: As an important measure to develop people’s democracy in the whole process, the establishment of grass-roots legislative contact points has constitutional basis, and its function must be realized by means of constitutional system, organization and procedure. The norms of national tasks, direct democracy and organizational activities in the Constitution of China can meet the substantive constitutional requirements of creating grass-roots legislative contact points. As an internal reinforcement system of representative democracy, grass-roots legislative contact points should be positioned as permanent institutions for the expression of public interests in organizational operation. The constitutional realization of grass-roots legislative contact points requires the implementation of the people’s democratic concept of full chain, all-round and full coverage in the whole process, and the strengthening of construction in practice.
