法学博士生高质量培养的理与路

摘要: 法学博士教育作为我国法学学历教育的最高层次，在过去四十余年间经历了从初创到成熟的发展历程。通过对CLSCI来源期刊上法学博士生发文情况的统计分析，可以发现法学博士生发表CLSCI来源期刊难度极大，近两年CLSCI来源期刊上的法学博士生发文量持续保持在一个较低的水平，且期刊更倾向于发表独立署名的文章。如今影响法学博士生培养质量的主要问题突出体现为高校对博士生非学位论文发表的高要求与核心期刊现实发表难度之间的龃龉，可能会导致严重的学术道德失范现象。为实现法学博士生的高质量培养，今后应及时更新CLSCI来源期刊目录；调整论文发表要求，提升博士培养质量；增强网络在线出版，优化期刊审稿流程；通过高校与期刊的融合发展，构建中国特色法学学术话语体系，为推进法治中国建设培养真正经世致用的法律人才。

Abstract: As the highest level of legal education in China, the Juris Doctor education has experienced a development process from start-up to maturity in the past forty years. Through the statistical analysis of the published papers of doctoral students in law in CLSCI source journals, it can be found that it is very difficult for doctoral students in law to publish CLSCI source journals. In the past two years, the number of published papers of doctoral students in law in CLSCI source journals has kept at a low level, and journals are more inclined to publish articles with independent signatures. Nowadays, the main problem that affect the quality of the training of doctoral students in law is prominently reflected in the discord between the high requirements of universities for the publication of doctoral non-degree papers and the difficulty of the actual publication of core journals, which may lead to serious academic moral anomy. In order to achieve high quality training of doctoral students in law, CLSCI source journals should be updated in time. Adjust the requirements of paper publication and improve the quality of doctoral training; Enhance online publishing and optimize the review process of journals; Through the integrated development of universities and periodicals, the academic discourse system of law with Chinese characteristics is constructed, and the legal talents who are truly practical and practical are cultivated for promoting the construction of the rule of law in China.
