我国预印本文本和数据挖掘著作权政策的问题与完善

摘要: [目的/意义]预印本文本和数据挖掘著作权政策的健全性对促进科技发展具有重要意义。我国预印本文本和数据挖掘著作权政策仍存在诸多问题，有待进一步完善。[方法/过程]本文通过调研国内外预印本平台著作权政策和著作权法律规则，梳理政策现状，并通过比较国内外政策的差异，发现我国可能存在的问题，并提出相应的完善对策。[结果/结论]在平台著作权政策方面，应当通过明确作者针对文本和数据挖掘的许可、授予平台支持文本和数据挖掘的权利、表明平台针对文本和数据挖掘的立场、鼓励平台提供文本和数据挖掘的资源以及适当放宽平台对用户抓取数据的限制，进一步优化平台著作权政策。在著作权法律规则方面，应当通过解释现有规则合法化小规模、非商业性的文本和数据挖掘行为，并通过引入新的规则为大规模的和商业性的文本和数据挖掘行为设立著作权例外。

Abstract: [Purpose/significance] The copyright policy for text and data mining of preprint is of great significance to promote the development of science and technology. There are still many problems in the copyright policy for text and data mining of preprint in China, which need to be further improved. [Method/process] By investigating domestic and foreign platform copyright policies and copyright laws, this paper sorts out the current state of the policies, and finds out the possible problems in policies in China by comparing the differences between domestic and foreign policies, and puts forward corresponding countermeasures. [Result/conclusion] In terms of platform copyright policies, we should clarify the author’s license for text and data mining, grant the platform the right to support text and data mining, indicate the platform’s position on text and data mining, encourage the platform to provide text and data mining resources, and appropriately relax the platform’s restrictions on users’ data capture. In terms of copyright law, small-scale, non-commercial text and data mining should be legalized by interpreting existing rules, and copyright exception should be established for large-scale and commercial text and data mining by introducing new rule.
