知识产权制度赋能新质生产力发展的优化路径——以“基金激励机制”为视角

摘要:
知识产权制度长久以来被视为保护和激励创新之关键，同时也承担着赋能新质生产力发展的重要使命。随着生成式人工智能技术的飞速发展，传统知识产权激励理论在证成人工智能生成内容（AIGC）知识产权保护正当性时已显现出其局限性。基于著作权主体视角，人工智能模型无须也无法被激励；基于著作权客体视角，AIGC不具有可激励之稀缺性。健康影响力基金作为代表性的基金激励机制，在推动全球药品研发创新方面发挥着积极作用，其成熟的激励理念与制度设计为完善知识产权激励理论和促推新质生产力发展提供了借鉴性思路。面对引入基金激励机制时的“运行-出资-评估”三重现实困境，应充分发挥政府引导基金的作用，借鉴社会影响力投资中的影响评估测算方案，探索基金激励机制与知识产权激励理论协同作用、融合发展之可能。通过制度创新引领科技创新、产业创新，贯彻落实党的二十届三中全会精神，从根本上加快培育形成新质生产力。

Abstract:
The intellectual property system has long been regarded as the key to protect and encourage innovation, and also undertakes the important mission of enabling the development of new quality productive forces. With the rapid development of generative artificial intelligence technology, the traditional intellectual property incentive theory has shown its limitations in justifying the intellectual property protection of Artificial Intelligence Generated Content (AIGC). From the perspective of copyright subject, artificial intelligence need not and cannot be motivated; From the perspective of copyright object, AIGC is not incentivized by scarcity. As a representative fund incentive mechanism, health impact fund plays a positive role in promoting global drug R&D innovation. Its mature incentive system design scheme and concept provide a pioneering idea for improving the intellectual property incentive theory and promoting the development of new quality productive forces. In facing of the triple realistic dilemma of "Operation-Investment-Evaluation" when introducing the fund incentive mechanism, we should give full play to the role of government guidance fund, learn from the impact assessment and calculation scheme of social impact investment, and explore the possibility of synergistic and integrated development of fund incentive mechanism and intellectual property incentive theory. Leading the scientific and technological innovation and industrial innovation through institutional innovation, implement the spirit of the Third Plenary Session of the 20th CPC Central Committee, and fundamentally accelerate the cultivation and formation of new quality productive forces.
