滇黔谳狱教范：伊里布编著《学案初模》《学案续编》发覆

摘要: 清道光年间伊里布任云贵总督，其在任期间颇重刑名，曾编著《学案初模》《学案续编》指导治下滇黔地区案件审办。《学案初模》《学案续编》二书以实用且易于地方府厅州县实践仿摹为要旨，辑录了四十例滇省当时常见的各类型成案，并附有伊里布注解案件审办要点的批语。梳理《学案初模》《学案续编》的编著要旨、辑录案件特征、批注详情，展现出伊里布所倡导的简明执要的地方治案模式，也显示了伊里布强调实用性规范并灵活融合社会治理需要的法律思想。

Abstract: During the Daoguang period of the Qing Dynasty, Yilibu served as the Governor-General of Yunnan and Guizhou, where he placed significant emphasis on criminal justice matters. He compiled Initial Model Cases and Supplemental Model Cases to guide the handling of legal cases in Yunnan and Guizhou. These two books were intended to be practical and easy for local officials at various administrative levels—prefectures, departments, sub-prefectures, and counties—to follow. The books include forty examples of common legal cases from Yunnan at the time, along with Yilibu’s annotations highlighting key points in case adjudication. By analyzing the purpose of these compilations, the characteristics of the selected cases, and the details of the annotations, one can see the concise and practical approach Yilibu advocated for local case handling. It also reveals his legal philosophy, which emphasized practicality while integrating flexibility with the needs of social governance.
