The Dilemma and Countermeasures of Judicial Application of the New Vocational Education Law—An Analysis Based on Judgments from China Judgments Online
摘要: 法律的司法适用是检验立法及适用性的重要标准。2022年5月1日,新修订的《职业教育法》正式实施。文章围绕时间与地域分布、法院层级与纠纷类型、援引条文分布等维度,选取2022年5月1日起法院援引新《职业教育法》的36份裁判文书进行分析,发现新《职业教育法》虽然历经26年重新修订,其司法适用性仍然很低。存在诸如宣传普及不到位、公众法律意识淡薄、条文援引形式模糊、与其他法律条文相比地位相对较低等问题仍然存在。为此,应规范条文援引规则,做好宣传教育,引导公众知晓新《职业教育法》的地位。同时继续提高新《职业教育法》立法质量,与时俱进,建立定期修法机制,构建与新时代职业教育发展相适应的法律体系,为保障我国职业教育高质量发展贡献法律力量。
Abstract: The judicial application of a law is an important criterion for assessing its legislation and applicability. On May 1, 2022, the newly revised Vocational Education Law was officially implemented. This article analyzes 36 judgments citing the new Vocational Education Law since May 1, 2022, from dimensions such as time and geographical distribution, court levels and types of disputes, and the distribution of cited articles. It is found that despite being revised after 26 years, the judicial applicability of the new Vocational Education Law remains low. Issues such as inadequate promotion and popularization, weak public legal awareness, vague citation of articles, and a relatively low status compared to other legal provisions still persist. Therefore, it is necessary to standardize the rules for citing articles, conduct effective promotion and education to raise public awareness of the status of the new Vocational Education Law. Additionally, efforts should be made to continuously improve the legislative quality of the new Vocational Education Law, keep it up-to-date, establish a regular mechanism for amending the law, and construct a legal system that aligns with the development of vocational education in the new era, contributing legal support to ensure the high-quality development of vocational education in China.
