论中国极地法律外交的能力建设

摘要: 法律外交是中国极地外交进入新发展阶段的重要目标，也是中国推动人类命运共同体实践、参与全球治理体系建设的必经之路。积极推进极地法律外交的能力建设，有助于强化中国进一步深入参与极地事务的话语实践，服务国家的战略决策。中国极地法律外交能力建设的内部提升路径可分为五个方面，即开展专业性的极地法律外交培训需求评估、构建国内国际双层多轨的极地法律外交沟通对话机制、综合分析中国的极地法律外交能力、制定并实施中国极地法律外交的能力发展方案和加强中国极地法律外交的评估能力建设。中国极地法律外交能力建设的外部提升路径也可分为五个方面，包括充分参与极地治理的相关国际体制、积极创新极地双边与多边合作机制、强化推进与极地非政府组织的合作关系、有效推动极地治理体系的国家实践和全面统筹经略海洋与极地事务。通过极地法律外交的能力提升，可以在中国现已取得令世人瞩目的极地成就的现实实践基础上，由内而外构建并完善中国在极地治理领域的法律外交体系，为开启南北两极的国际合作善治新局面提供理念指引，同时助力中国外交事业的法治化和中国式现代化建设。

Abstract: Legal diplomacy is an important goal for China ’s polar diplomacy to enter a new stage of development, and it is also the only way for China to promote the practice of a community of shared future for mankind and participate in the construction of a global governance system. Actively promoting the capacity building of polar legal diplomacy will help strengthen China ’s further participation in the discourse practice of polar affairs and serve the country ’s strategic decision-making. The internal improvement path of China’s polar legal diplomacy capacity building can be divided into five aspects, namely conducting professional polar legal diplomacy training needs assessment, constructing a dual layer and multi track polar legal diplomacy communication and dialogue mechanism at home and abroad, comprehensively analyzing China’s polar legal diplomacy capacity, formulating and implementing capacity development plans for China’s polar legal diplomacy, and strengthening the evaluation capacity building of China’s polar legal diplomacy. The external improvement path for China’s polar legal and diplomatic capacity building can also be divided into five aspects, including fully participating in the relevant international system of polar governance, actively innovating bilateral and multilateral cooperation mechanisms in polar regions, strengthening cooperation with polar non-governmental organizations, effectively promoting the national practice of polar governance system, and comprehensively coordinating ocean and polar affairs. Through the improvement of the ability of polar legal diplomacy, we can build and improve China ’s legal diplomacy system in the field of polar governance from the inside out on the basis of the practical practice of China ’s polar achievements that have attracted worldwide attention. It provides conceptual guidance for opening up a new situation of good governance in international cooperation between the North and the South, and at the same time helps the rule of law in China ’s diplomatic cause and the modernization of Chinese style.
