数字纪检监察的法治化重构

摘要: 数字纪检监察是纪检监察工作顺应数字潮流的新型权力监督方式，相较于传统纪检监察而言具有提效、增质的特点。但实践中的数字纪检监察应用，面临着数据标准与治理难以协同、数字技术应用困难、法律法规与政策存在体系性漏洞、部门间信息流通沟通不畅等问题。应从数字法治的基本逻辑出发，探究数字纪检监察的理论内涵，解析数字纪检监察的底层逻辑，提取数字纪检监察在理论、技术、制度三个层面的优势。在技术与法治之间，寻找理性平衡和融通，从体制机制、技术应用、法律和政策协同等方面寻求可行的进路，夯实数字纪检监察的实践基础，增强数字纪检监察工作的质量和效率，实现数字纪检监察的法治化重构。

Abstract: Digital discipline inspection and supervision is a new oversight mechanism aligned with digital trends, characterized by enhanced efficiency and quality compared to traditional methods. However, its practical implementation faces challenges including difficulties in coordinating data standards and governance, obstacles in applying digital technologies, systemic gaps in laws, regulations and policies, as well as poor interdepartmental information flow communication. It should start from the fundamental logic of the digital rule of law, delving into the theoretical underpinnings of digital discipline inspection and supervision, analyzing its core operational principles, and identifying its strengths at the theoretical, technological, and institutional levels.Between technological advancement and the rule of law framework, a rational balance and integration must be sought.Feasible pathways should be explored through institutional reforms, technological implementation, legal enhancements, and policy coordination.By consolidating the practical foundations of digital disciplinary oversight, improving its efficiency and effectiveness, and ultimately achieving the restructuring of the rule of law in digital disciplinary supervision, a sustainable governance model can be established.
